Every industrial or commercial establishment operating in Uttar Pradesh that has the potential to impact the environment must obtain mandatory environmental clearances from the Uttar Pradesh Pollution Control Board (UPPCB). These clearances, known as Consent to Establish (CTE) and Consent to Operate (CTO), are legal requirements under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The UPPCB, headquartered in Lucknow with twenty-five regional offices across the state, functions as the primary regulatory authority responsible for monitoring and controlling pollution levels within the state’s boundaries. Whether you are setting up a new manufacturing unit, expanding an existing facility, or running day-to-day operations, understanding and complying with these consent requirements is essential to avoid legal penalties and ensure smooth business operations.

The Consent to Establish (CTE) is the first permission you need before beginning any construction or installation work for your industrial or commercial project. The UPPCB categorizes all industries into four groups based on their pollution potential: Red (highly polluting), Orange (moderately polluting), Green (low polluting), and White (non-polluting). Industries falling under Red, Orange, and Green categories require CTE, which remains valid for one year or until the project is completed and installed, whichever comes first. White category industries are exempt from obtaining CTE or CTO altogether as per recent amendments. To obtain CTE, applicants must submit comprehensive documentation including ownership proof, constitutional documents, detailed project reports, process flowcharts, pollution control measures, environmental clearance (if applicable under EIA notification), groundwater clearance, and land use classification certificates. The application is submitted online along with the prescribed fees, following which the UPPCB conducts site inspections to verify the information and assess environmental compliance before granting the consent.

Once your project construction is complete and all pollution control equipment has been installed as per the CTE conditions, you must obtain Consent to Operate (CTO) before starting actual operations. The CTO certifies that your facility has implemented all necessary pollution control measures and is fit to commence operations without causing environmental harm. The UPPCB inspects the completed facility to ensure that all conditions stipulated in the CTE have been met, pollution control devices like effluent treatment plants and air pollution control systems are functional, and proper waste management systems are in place. CTO is issued for different validity periods. Required documents for CTO include a copy of the valid CTE, layout plans, compliance reports on CTE conditions, latest audited balance sheets, photographs of installed pollution control measures, waste and emission analysis reports, and compliance statements for environmental clearance conditions where applicable. Industries must apply for renewal well before the expiry of their CTO, submitting updated compliance reports and demonstrating continued adherence to environmental standards.
