Groundwater constitutes a vital natural resource that supports agriculture, industry, domestic consumption, and ecological balance across India. Recognizing the critical importance of sustainable groundwater management, the Central Ground Water Authority (CGWA) was constituted in January 1997 under sub-section 3 of Section 3 of the Environment (Protection) Act, 1986, pursuant to the directions of the Honorable Supreme Court of India. The CGWA has been vested with extensive powers to regulate and control groundwater development and management throughout the country by issuing No Objection Certificates (NOCs) for groundwater extraction to industries, infrastructure projects, mining operations, bulk water suppliers, and other commercial users.

While water is fundamentally a state subject under the Indian Constitution, groundwater regulation operates at both central and state levels to ensure comprehensive management. The CGWA directly regulates groundwater withdrawal in twenty states and two union territories, while fourteen states and union territories have enacted their own groundwater legislation and established State Ground Water Authorities (SGWAs) or designated regulatory bodies that function under state-specific acts or government orders. NOC holders are required to implement rainwater harvesting systems in project areas wherever groundwater levels have depleted beyond five meters below ground level, construct artificial recharge structures such as percolation pits and recharge wells based on site-specific hydrogeological conditions, pay water conservation fees or groundwater restoration charges as prescribed in the NOC conditions based on extraction quantum and area classification, submit half-yearly compliance reports through the web portal detailing actual extraction, rainwater harvesting measures implemented, artificial recharge activities undertaken, and groundwater level monitoring data, and conduct periodic water audits by independent agencies to assess water use efficiency and identify conservation opportunities.
